Reopen SDUSD Class Action Lawsuit

 Dear SDUSD Friends and Families! 

This is an important update to our campaign. As you know, “Reopen SDUSD” has joined families the entire school year asking Cindy Marten and the San Diego Unified School Board to reopen our schools with definitive options for in-person learning. To this day, San Diego Unified continues to deny the needs of our children and families. 

We have serious concerns that SAN DIEGO UNIFIED has failed to properly educate our children during this pandemic. Under California law, school districts are required to provide students with a minimum number of instructional hours. While a pandemic is unusual, it does not excuse the District’s responsibility to provide instructional hours, as they have done during wildfires, excessive snow or rain and other events that close schools. 

SDUSD may have violated the law by failing to provide sufficient instructional hours during the 2019-2020 and 2020-2021 school years and have left it to parents to make up for any loss of education, after taking millions of dollars to safely reopen San Diego schools. 

As we have earnestly strived to communicate with the District, we were being advised that the only way for SDUSD to take parents seriously is to file a suit against the District. 

WE BELIEVE THE NEXT STEP TO HOLDING SDUSD ACCOUNTABLE IS THROUGH A CLASS ACTION LAWSUIT. 

This is where we need YOU! If you are a parent with a child who was enrolled during the 2019-2020 school year and / or currently enrolled at San Diego Unified, this is the time for you. We need families who are willing to be a named plaintiff in this class action case to hold SDUSD accountable. 

The Class will be represented by a retired California judge who is focused on educational issues.
